Stare Decisis, My Ass

Bush and RobertsIn what will surely be remembered as one of the darkest summers in the history of the Supreme Court, the 5 man wrecking crew John Roberts, Samuel Alito et al have begun to dismantle settled court decisions, some that have been in place for more than 30 years. With today’s gutting of the desegregation plans in Seattle and Kentucky, Brown v. Board of Education is barely alive.

The court earlier this week decided that McCain-Feingold’s prohibition on corporate-funded attack ads run immediately before an election (that often have a clear intent to attack late leaving no time for candidates to respond) is a violation of the a corporation’s right to free speech and at the same time in Morse v. Frederick decided that a student’s comical sign “Bong Hits for Jesus” could be restricted since that speech advocated something against the law. The right to pervert the electoral process must be protected!

I have often noted that George W. Bush will be remembered as the worst president ever, but through his Supreme Court appointments Bush leaves a legacy that will haunt the United States for decades to come.
